Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and League of Pumps ("we", "us", "our"), governing your use of the League of Pumps mobile application ("the App") and website ("the Site") (collectively, "the Service").

By accessing or using the Service, you confirm that you are at least 13 years old and that you agree to be bound by these Terms and our Privacy Policy.

2. License to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, solely for your personal, non-commercial use, in accordance with these Terms.

You must not:

• Copy, modify, distribute, sell, or sublicense any part of the App or Service
• Reverse engineer, decompile, or disassemble the App
• Use the Service for any unlawful or fraudulent purpose
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Upload or transmit viruses or any malicious code
• Interfere with the integrity or performance of the Service

3. User accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or otherwise misuse the Service.

4. Health and safety disclaimer

League of Pumps is a fitness tracking tool. It is not a medical device, and its form analysis is not a substitute for professional instruction or medical advice.

Consult a qualified healthcare professional before starting any new exercise programme, especially if you have pre-existing health conditions, injuries, or have been inactive for an extended period. By using the App, you acknowledge that physical exercise carries inherent risks, and that you exercise at your own risk.

The form feedback provided by the App is based on generalised biomechanical benchmarks and may not be appropriate for all bodies, fitness levels, or exercise variations. Do not use the App as your sole reference for exercise technique.

5. Leaderboards and competitive features

Leaderboard rankings are based on workout data generated through the App. Any attempt to manipulate, automate, or otherwise falsify workout data to inflate rankings is a violation of these Terms and may result in immediate account termination.

6. Intellectual property

The Service and its original content — including the App interface, design, code, pose-detection models, graphics, and text — are owned by League of Pumps and protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

Your workout data belongs to you. We use it only as described in our Privacy Policy.

7. Availability and modifications

We do not guarantee that the Service will be available at all times or free from errors. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will provide advance notice via email or in-app notification.

8. Third-party services

The Service integrates with third-party providers including Google (authentication and app distribution) and Brevo (email delivery). Your use of those services is subject to their respective terms and policies. We are not responsible for the practices of third-party services.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by applicable law, League of Pumps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to loss of data, physical injury from exercise, or loss of reputation.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed EUR 100 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
